In October 2016 the Building (Pools) Amendment Act 2016 was passed, revoking the Fencing of Swimming Pools Act 1987 (FOSP) and incorporating child safety provisions for residential swimming pools, into the Building Act 2004. A new clause was also added to the Building Code: Clause F9 'Means of Restricting Access to Residential Pools'.
This act came into force on 1 January 2017, revoking FOSP Act 1987 and enacting Clause F9. MBIE have now published two new Acceptable Solutions for Building Code Clause F9, which came into effect on April 27 2017.
F9/AS1 applies to residential pool barriers and F9/AS2 applies to small heated pools such as spa pools, with a water surface area of 5m² or less.
F9/AS1 uses most of the requirements for fences, barriers, gates and doors that were presented by the Schedule to the Fencing of Swimming Pools Act.
F9/AS2 specifies the Building Code requirements for removable pool covers, which can be used on small heated pools in place of pool fences. Construction and robustness of the covers are stipulated and the MBIE is confident that many of the spa pool covers manufactured in recent years are likely to meet specifications.
